Terms of Service
The core terms governing how customers use GetHandy's marketplace platform and related services.
1. Overview & Acceptance
GetHandy Inc. ("GetHandy", "we", "us") operates a marketplace platform that connects customers with independent service providers ("Providers"). By creating an account or using GetHandy, you ("Customer", "you") agree to these Customer Terms of Service ("Terms").
GetHandy does not itself provide, perform, or guarantee any services listed on the platform. GetHandy facilitates the connection between you and Providers but is not a party to any service agreement between you and a Provider.
2. Definitions
"Customer" means any individual who creates an account to request, browse, or book services through the platform.
"Provider" means an independent service professional who offers services through the platform.
"Service" means the work, labour, or expertise performed by a Provider on your behalf.
"Engagement" means any booking, task, or project arranged through the platform between you and a Provider.
"Platform" means the GetHandy mobile applications, websites, and related technology services.
3. Your Account
You must be at least 18 years of age to create an account. You agree to provide accurate, complete, and current information during registration and to update it as needed.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify GetHandy immediately if you suspect unauthorized access.
One account per person. Do not share your login credentials or allow others to use your account.
4. How the Marketplace Works
You may post tasks describing work you need done, browse Provider profiles, request quotes, and book services through the platform.
Any agreement for services is between you and the Provider directly. Providers are independent contractors, not employees, agents, or representatives of GetHandy.
GetHandy does not control the manner or method of service delivery, does not set Provider rates (Providers set their own), and does not supervise the work performed.
5. Your Responsibilities as a Customer
When using the platform, you agree to:
- Provide accurate and complete task descriptions, including scope, location, and any relevant conditions.
- Provide a safe working environment free from hazards that are not disclosed in the task description.
- Be present or available as agreed for the scheduled Engagement.
- Treat Providers with respect and professionalism at all times.
- Report issues, concerns, or disputes promptly through the platform.
- Not solicit or arrange payment with Providers outside the platform for work facilitated by GetHandy.
6. Payments, Fees & Refunds
All payments for services are processed through the platform. GetHandy charges a service fee on each transaction, which is disclosed before you confirm a booking.
Refund eligibility depends on task status and cancellation timing. Cancellation more than 24 hours before the scheduled start qualifies for a full refund. Cancellation within 24 hours may incur a cancellation fee.
Disputed charges are handled through GetHandy's resolution process. Both you and the Provider will have an opportunity to provide information before a determination is made.
GetHandy may hold, release, or adjust payments as needed to resolve disputes fairly.
7. GetHandy Service Guarantee
If work performed through the platform is materially incomplete or defective, you may report the issue within 30 days of the Engagement. GetHandy may, at its discretion, arrange a redo with the same or different Provider, issue a credit, or provide a refund.
Property damage claims related to an Engagement must be reported within 14 days with supporting documentation (photos, receipts, or estimates).
The GetHandy Service Guarantee is secondary to any insurance the Provider carries. Coverage is limited to the lesser of the full task price or CAD $10,000 per occurrence for property damage claims.
Exclusions: pre-existing conditions, damage unrelated to the service performed, consequential or indirect damages, loss of use, and claims not reported within the required timeframes.
8. Limitation of Liability
GetHandy's role is limited to operating the platform and facilitating connections between Customers and Providers.
To the maximum extent permitted by applicable law, GetHandy is not liable for: the quality, safety, legality, or timeliness of services performed by Providers; property damage, personal injury, or other losses arising from a Provider's acts or omissions; disputes between you and a Provider that are not resolved through our process.
GetHandy's aggregate liability for any claims arising from your use of the platform is limited to the greater of (i) the total service fees paid by you to GetHandy in the 12 months preceding the claim, or (ii) CAD $500.
9. Indemnification
You agree to indemnify and hold harmless GetHandy, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, losses, or expenses arising out of or related to:
- Your misuse of the platform or violation of these Terms.
- Inaccurate, misleading, or incomplete task descriptions that cause harm to a Provider or third party.
- Your violation of any applicable law or regulation.
10. Privacy & Data
GetHandy collects and uses personal information in accordance with its Privacy Policy and the Personal Information Protection and Electronic Documents Act (PIPEDA).
Provider contact information is shared with you only as needed to complete an Engagement. You agree not to use Provider personal information for purposes unrelated to the service.
11. Modifications to Terms
GetHandy may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect.
Your continued use of the platform after the effective date of updated Terms constitutes acceptance. If you disagree with the changes, you may close your account before the effective date.
12. Governing Law & Disputes
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
If a dispute arises, you agree to first attempt informal resolution by contacting GetHandy support. GetHandy will respond within 14 days. If the dispute is not resolved informally, either party may pursue mediation or proceed to the courts of Saskatchewan.
You retain all rights to access courts and to participate in class proceedings available under applicable law.
